The Failure of the 28-Article Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the announcement of a new 28-point plan for ending the war appeared – briefly – to have been defused. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its countermove: a renewed assault of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the current period. By day, diplomatic battles are waged: optimistic declarations are released from various governments. Significant resources is devoted on managing specific proposals. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was laid bare. Ukraine is able to track rocket firings from across the border, a ability provided through current data. From vantage locations, military aircraft that had been deployed to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by NATO members.

Soon thereafter, Kyiv's missile defense activated: several firings fired to intercept a incoming threat. This was a sophisticated defense system at work, presumably supplied through allied countries. Every firing jolts you unexpectedly, rattling buildings. The brief panic quickly transforms into sober acceptance: perhaps the incoming missile won't cause damage this time, protecting urban areas from devastation and further power outages.

Continuous Dangers

Soon after, a large-caliber weapon fired at a unmanned aircraft somewhere nearby, part of a defensive team – most likely Western-made equipment. Sadly, the bullets missed the hostile drone – it maintained course toward its destination.

Periodically, this persisted until dawn. Kyiv greeted the morning news: multiple fatalities, devastation and heating outages in numerous residences as a result of the night's assault. As always, everyone still maintained normal activities – enduring hostilities. But those 24 hours encapsulated Ukraine's essential dependence on external assistance – a dependence that regional partners are demonstrably unable to replace in the short term.

Failed Diplomacy

The detailed framework from US administration generated strong feelings, discussion and deep concern – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from American administration follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually achieve victory. This cycle will, undoubtedly, continue.

Tactical Assessments

It is convenient to criticize specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the whole story. Washington functions according to a principle well known to international relations experts: you cannot achieve through diplomacy what you have failed to defend militarily. The American government assumes that it is impossible to compel Moscow to relinquish the land that it presently holds in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, American administration does nothing to discourage Russia, through words or deeds, from assuming that the status quo will not change more in its advantage in the near future.

Opposing Positions

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their motivation to accept conditions that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to end hostilities, but they will persist as long as Russia's government remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing civilians and areas but preventing a total frontline collapse until situations evolve in its favour.

Current Realities

Factually, there are no genuine requirements for a truce. Now, personal considerations are becoming relevant: political desires to negotiate peace and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unsuitable, so that their attention does not shift toward homefront challenges. And although their task will now be much harder after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Conclusion and Outlook

It took a mere seven days to terminate the 28 points of the most recent proposal. Aggressive and erratic handling of the matter by US administration, resistance by Ukraine and the other European countries, along with calming attempts of representatives, and finally, latest revelations, all achieved their purpose.

While new plans based on established approaches are approaching, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and show specific hesitation to modify developments, if they remain united and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, mainly require continued Western support.
